PowerAether Intelligence is committed to protecting your personal data and respecting your privacy. This policy explains what data we collect, why we collect it, how we use it, and what rights you have under the General Data Protection Regulation (GDPR) and Spain's Ley Orgánica de Protección de Datos (LOPD-GDD).
1. Who we are
PowerAether Intelligence is operated as a sole proprietorship (autónomo) registered in Madrid, Spain. For the purposes of GDPR, we are the data controller of personal data collected through our website (poweraether.com, power-aether.com) and our email newsletters.

2. What data we collect
2.1 Information you give us when subscribing
When you subscribe to one of our newsletters via the subscription form, we collect:
- Email address (required) — to deliver the newsletter and account communications
- First name (required) — for personalized greetings in newsletter emails
- Company / organization (optional) — to understand our subscriber base
- Role (optional) — to understand our subscriber base
- Edition preference (North America, Europe, or both)
2.2 Information collected when you make a paid subscription
When you subscribe to a paid plan, payment is processed by Stripe Payments Europe Ltd. via our newsletter platform Beehiiv. We never receive, see, or store your credit card details, bank account numbers, or any other payment instrument data. Stripe holds this data subject to its own privacy policy and is PCI-DSS Level 1 certified.
We do receive from Stripe: your subscription status (active/cancelled), the plan you subscribe to, the date of your subscription, and the country of your billing address (used for VAT calculation).
For Spanish business customers and EU B2B customers we additionally collect, when applicable: company VAT/NIF-IVA number for invoicing purposes (mandatory under Spanish e-invoicing law from 1 July 2026).
2.3 Information collected automatically
When you visit our website or open our emails:
- IP address — collected by our hosting provider for security and abuse prevention; retained for up to 30 days
- Browser type and operating system — for compatibility analytics
- Pages visited — to understand which content is useful
- Email open and click data — collected by Beehiiv to measure newsletter engagement (you can opt out of this in your subscriber preferences)
3. Why we collect it (legal basis)
Under GDPR Article 6, our legal bases for processing are:
- Performance of a contract (Art. 6(1)(b)) — to deliver the newsletter you subscribed to and process payment
- Legitimate interest (Art. 6(1)(f)) — to operate, secure, and improve the website and service; to send transactional emails about your subscription
- Legal obligation (Art. 6(1)(c)) — to issue tax-compliant invoices, retain invoice records for the legally required period (currently 6 years in Spain)
- Consent (Art. 6(1)(a)) — for any marketing emails outside the newsletter you subscribed to (we do not currently send these)
4. How we use your data
We use your personal data to:
- Deliver the biweekly newsletter PDF to your inbox
- Send transactional emails about your subscription (renewal, cancellation, invoices)
- Process payments via Stripe
- Issue tax-compliant invoices (mandatory for Spanish autónomos)
- Provide customer support if you contact us
- Understand our subscriber base in aggregate (without identifying individuals)
We do not sell, rent, or trade your personal data. We do not run advertising on our website or in our emails. We are subscriber-funded and have no incentive to monetize your data.
5. Who we share your data with
We use the following data processors, each bound by a Data Processing Agreement (DPA) with us:
- Beehiiv Inc. (USA) — newsletter platform; hosts subscriber list, sends emails. Beehiiv is GDPR-compliant and uses EU Standard Contractual Clauses for cross-border transfers.
- Stripe Payments Europe Ltd. (Ireland) — payment processing. Holds payment information in EU data centers.
- Holded or equivalent (Spain) — accounting and Spanish e-invoicing platform.
- Our website hosting provider — name disclosed on request.
We share your data with these processors only to the minimum extent necessary to provide the service.
We may also disclose your data if required by law: in response to a valid order from a Spanish court, the Spanish tax authority (Agencia Tributaria), or another competent authority.
6. International data transfers
Beehiiv is based in the United States. When you subscribe, your email address and subscriber data are transferred to and stored on Beehiiv's servers, which may be in the US. This transfer is protected by the EU Standard Contractual Clauses (SCCs) and Beehiiv's commitment to GDPR-compliant data handling.
Stripe stores EU customer data in EU data centers. Holded operates from Spain.
7. How long we keep your data
- Active subscribers: for as long as your subscription is active, plus 30 days after cancellation (to allow reactivation)
- Cancelled / unsubscribed users: we delete email and personal data within 30 days of unsubscription, unless we are legally required to retain it
- Invoices and tax records: retained for 6 years as required by Spanish tax law (Ley General Tributaria)
- Aggregated, anonymized analytics: retained indefinitely
8. Your rights under GDPR
You have the following rights with respect to your personal data:
- Right of access (Art. 15) — request a copy of all personal data we hold on you
- Right to rectification (Art. 16) — request correction of inaccurate or incomplete data
- Right to erasure / "right to be forgotten" (Art. 17) — request deletion of your data, subject to our legal retention obligations
- Right to restriction of processing (Art. 18) — request that we limit how we use your data
- Right to data portability (Art. 20) — receive your data in a structured, machine-readable format
- Right to object (Art. 21) — object to processing based on legitimate interests
- Right to withdraw consent — at any time, where processing is based on consent
- Right to lodge a complaint with the Spanish data protection authority — Agencia Española de Protección de Datos (AEPD)
To exercise any of these rights, email info@poweraether.com. We will respond within 30 days. We will never charge you for exercising your rights, and we will not retaliate against you for doing so.
9. Cookies
Our website uses the following types of cookies:
- Strictly necessary cookies — required for the website to function (e.g., remembering you've dismissed the cookie banner). These do not require consent.
- Analytics cookies — help us understand how the website is used. We use only privacy-respecting analytics (no Google Analytics fingerprinting). These require consent.
You can withdraw consent for non-essential cookies at any time via the cookie banner or by clearing your browser cookies.
10. Security
We take reasonable technical and organizational measures to protect your data, including: HTTPS encryption for all website traffic, encrypted data transmission with our processors, access controls limiting who can view subscriber data, and regular security reviews of our processors.
However, no method of transmission over the internet or electronic storage is 100% secure. If we discover a data breach affecting your personal data, we will notify you and the AEPD within 72 hours, as required by GDPR Article 33.
11. Children's data
PowerAether Intelligence is a B2B publication intended for professionals. We do not knowingly collect data from anyone under 16. If you believe we have inadvertently collected data from a minor, please email info@poweraether.com and we will delete it.
12. Changes to this policy
We may update this privacy policy from time to time. Material changes will be communicated via email to all active subscribers at least 30 days before they take effect. The current version is always available at poweraether.com/privacy.
